Please read these Terms of Service (“Terms”) carefully before using www.trendsbymasterhooks.com and the Trends by Masterhooks newsletter, website, and related platform, tools, and services (collectively, the “Service”), operated by “Masterhooks” (“we,” “us,” or “our”).

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, subscribers, users, and others who access or use the Service.

By accessing, subscribing to, or using the Service, you agree to be bound by these Terms. If you do not agree, you do not have permission to access the Service.

You may not use, as a username, the name of another person or entity, a name subject to another party’s rights without authorization, or any name that is offensive, vulgar, or obscene.

We reserve the right to refuse service, terminate accounts, remove or edit Content, or cancel orders at our sole discretion.

6. Paid Plans, Purchases, and Refunds

If you purchase any product or paid plan through the Service, you agree to provide accurate, complete billing information, and you represent that you are authorized to use the payment method provided.

We use third-party payment processors to facilitate payments. By submitting your payment information, you authorize us to share it with those processors, subject to our Privacy Policy.

Fees are charged in advance. Subscriptions renew automatically unless cancelled before the renewal date. We may change pricing on a prospective basis with reasonable notice; continued use after a change constitutes acceptance.

Refunds: No refunds. Because the Content is a digital product delivered immediately, all sales are final and payments are non-refundable.

We reserve the right to refuse or cancel any order for reasons including availability, pricing or description errors, or suspected fraud.

7. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of these Terms;
• Interfere with, disrupt, or attempt to gain unauthorized access to the Service or its infrastructure;
• Introduce malware or engage in any activity that could damage or overburden the Service;
• Impersonate any person or misrepresent your affiliation;
• Use automated means (bots, scrapers) to access or extract the Content except as we expressly permit.

8. Intellectual Property

The Service and all Content are the exclusive property of Masterhooks or its licensors and are protected by copyright, trademark, and other laws of the United States and other countries.

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Content for your own personal or internal business use.

You may not, without our prior written permission: (a) distribute, resell, republish, or commercially exploit the Content; (b) scrape, copy, or systematically extract the Content; (c) use the Content to train machine-learning or AI models; or (d) remove any proprietary notices.

“Trends by Masterhooks,” “Masterhooks,” and associated logos and trade dress are our trademarks and may not be used without our prior written consent.

10. Copyright Claims (DMCA)

We respect the intellectual property rights of others and respond to notices of alleged infringement.

If you believe Content on the Service infringes your copyright, send a written notice to trends@masterhooks.com with the subject line “Copyright Infringement,” including: (a) your physical or electronic signature; (b) identification of the copyrighted work; (c) the URL or location of the allegedly infringing material; (d) your contact details; (e) a statement of good-faith belief that the use is not authorized; and (f) a statement, under penalty of perjury, that your notice is accurate and that you are the owner or authorized to act on the owner’s behalf.

Bad-faith or misrepresented claims may make you liable for damages, including costs and attorneys’ fees.

11. Third-Party Links and Services

The Service may link to third-party websites or services we do not own or control. We are not responsible for their content, privacy policies, or practices, and are not liable for any loss arising from your use of or reliance on them. We advise you to review their terms and privacy policies.

12. Disclaimers

Your use of the Service is at your sole risk. The Service is provided on an “AS IS” and “AS AVAILABLE” basis, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MASTERHOOKS AND ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM

• (i) YOUR ACCESS TO OR USE OF, OR INABILITY TO ACCESS OR USE, THE SERVICE;
• (ii) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE;
• (iii) ANY CONTENT OBTAINED FROM THE SERVICE; OR
• (iv) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.

OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) USD 100.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

14. Indemnification

You agree to defend, indemnify, and hold harmless Masterhooks and its licensors, employees, contractors, agents, officers, and directors from any claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from (a) your use of the Service; (b) your breach of these Terms; or (c) Content you post or transmit.

15. Termination

We may suspend or terminate your access to the Service immediately, without prior notice or liability, at our sole discretion, including for any breach of these Terms.

To terminate: a Visitor may simply stop using the Service; a Subscriber may unsubscribe; a Registered User or Customer may delete their account or request deletion at trends@masterhooks.com.

Provisions that by their nature should survive termination including intellectual property, disclaimers, limitation of liability, and indemnification will survive.

16. Changes to the Service and Terms

We may modify or discontinue the Service, in whole or in part, at any time.

We may revise these Terms at any time. If a revision is material, we will provide at least 30 days’ notice before it takes effect (what “material” is determined at our discretion). Continued use after changes take effect constitutes acceptance. If you do not agree, you are no longer authorized to use the Service.

Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the Service will be subject to the exclusive jurisdiction of the state and federal courts located in Los Angeles County, California, and you consent to personal jurisdiction and venue there, unless otherwise required by applicable law.
